The terms of use below govern your use of this website. They exempt Covenant House Vancouver (“Covenant House”) and other persons from liability or limit their liability, and contain other important provisions that you should read. Each time that you use the website, you acknowledge and signify that you have read, understood, and agreed to be bound by these terms as they then read, and you represent and warrant that you have the legal authority to agree to and accept the terms below for yourself and any person that you represent. The website and its content may be used only by individuals located in Canada and only for their personal, non-commercial, and lawful purposes. If you do not accept and agree to the website’s terms of use, you may not use the website.
No Advice: The website may make available certain information provided by representatives of Covenant House or by third parties related to various matters including, but not limited to, social sciences, medicine and other health matters, law, accounting, and finances. The information appearing on the website is not a comprehensive or detailed statement concerning the matters addressed in it, and is not a substitute for professional consultation, evaluation, treatment, or particular course of action. The information on the website is intended to be used only for convenience and informational purposes only. Users should seek appropriate, qualified professional advice and recommendations before acting or omitting to act based upon any information displayed on or available though the website. Some of the information on the website may be out of date.
Website “As Is”: You agree that Covenant House will not be responsible or liable, directly or indirectly, in any way for any loss or damage of any kind incurred as a result of, or in connection with your use of, or reliance on, any information on the website, which is at your own risk. The website is provided on an “as is” and “as available” basis, and without any representations, warranties, guarantees, or conditions of any kind, whether express or implied, and including without limitation implied representations, warranties or conditions of title, non-infringement, merchantability, fitness for a particular purpose, performance, results, availability, timeliness, accuracy, or completeness, all of which are hereby disclaimed by Covenant House to the fullest extent permitted by law. The exclusion of certain warranties and the exclusion or limitation of certain liabilities is prohibited by legislation in some jurisdictions. Such legislative limitations may apply to you.
Liability Exclusion and Limitation: Under no circumstances will Covenant House or its employees, directors, officers, volunteers, agents, advisers, or any other representatives (collectively “Representatives”), jointly or severally, be liable to you or any other person for any loss, damage, expense, or cost incurred arising from, connected with, or relating to the use of the website or any of the information displayed on or available through the website by you or any other person, and regardless of any negligence or other fault or wrongdoing (including gross negligence) by Covenant House or any person for whom it is responsible, and notwithstanding that Covenant House or its Representatives may have been advised of the possibility of such loss or damage being incurred by you or any other person. Further, and without limiting the foregoing, in no event will Covenant House's or its Representatives’ total liability to you or any other person for any and all claims, proceedings, liabilities, obligations, damages, losses and costs, whether in contract, tort or under any other theory of law or equity, and regardless of any negligence or other fault or wrongdoing (including gross negligence) by Covenant House, a Representative, or any person for whom either is responsible, exceed $10 (CDN).
Forum: When participating in a forum available on the website (collectively "Forums"), you must never assume that people are who they say they are, know what they say they know, or are affiliated with whom they say they are affiliated. Covenant House cannot be responsible for the content or accuracy of any information, and will not be responsible for any reliance or decisions made based on such information. When using a Forum, you may not post, transmit, link to, or otherwise distribute any information or content that does not generally pertain to the designated topic or theme of the particular Forum. Use of a Forum for commercial purposes of any kind is strictly prohibited. Covenant House reserves the right to refuse to post or to remove any information or content, in whole or in part, that Covenant House deems, sole discretion, as unacceptable, undesirable, or in violation of any terms of use related to the website.
Submissions: If you upload submissions to the website, you agree not to:
- post, transmit, link to, or otherwise distribute any information or content constituting, advocating, or encouraging conduct that would constitute a criminal offense or give rise to civil liability, or otherwise use the website in a manner which is contrary to law or would serve to restrict or inhibit any other user from using or enjoying the website, internet, or any services provided by Covenant House;
- defame, abuse, stalk, harass, threaten or otherwise violate the legal rights of others, including, but not limited to, rights relating to privacy and publicity;
- post, transmit, link to, or otherwise distribute any information or inappropriate content, including but not limited to content that is, profane, defamatory, infringing, obscene, offensive, or indecent; and
- post, transmit, link to, or otherwise distribute any information or content (including for greater certainty, software) that contains a virus, cancelbot, trojan horse, worm or other harmful or disruptive component;
all of which may be determined by Covenant House in its sole discretion. Any uploaded material may be removed immediately and without notice to you.
Permission for Minor: If you are a minor, you must have permission from your parent or guardian to upload any content to the website. Covenant House may request a parent's or guardian's email address from anyone who uploads any materials to a Forum for the purpose of verifying with the parent or guardian that he/she has in fact given permission for such uploading.
Permission to Use Submissions: By submitting content to the website or in any Forum, you automatically grant (or warrant that the owner of such materials expressly grants) to Covenant House the world-wide, perpetual, royalty-free, irrevocable and non-exclusive permission to use, copy, adapt, transmit, communicate, publicly display and perform, distribute and create compilations and derivative works from such submitted content, for any purpose and in any form, media, or technology now known or later developed. In addition, you warrant that all non-assignable rights, including moral rights, in such content have been waived.
Monitoring: You acknowledge that Covenant House has no obligation to monitor the website, though it has the right to monitor it from time to time and to disclose any information as necessary to satisfy any law, regulation or other governmental request, to operate the website properly, or to protect itself or users of its services in accordance with the website’s privacy policy.
Modifications: Covenant House reserves the right, in its sole discretion, to add to, remove, modify or otherwise change any part of its website terms of use, in whole or in part, at any time. Except as otherwise expressly contemplated herein, changes will be effective when notice of such change is posted on the website. If any change is not acceptable to you, you must discontinue your use of the website immediately. Your continued use of the website after any such changes are posted will constitute acceptance of those changes. Further, Covenant House reserves the right to change, modify, suspend or discontinue any aspect of the website from time to time without notice or liability and for any reason whatsoever.
